
The Court of Appeal sitting in Abuja, on Friday, 29 March, 2023 vacated the tribunal judgment nullifying the election of Osun State Governor Ademola Adeleke.
The Appeal Court insisted that Adeleke of the Peoples Democratic Party (PDP) was duly elected and fairly defeated then sitting Governor Gboyega Oyetola of the All Progressives Congress (APC), contrary to the verdict of the Osun State Governorship Election Petition Tribunal, which nullified Adeleke’s election
The appellate court, in a unanimous decision by a three-member panel of Justices, read by Justice Mohammed Lawal ,held that Adeleke’s the appeal was meritorious and awarded N500,000 cost against Oyetola and the APC.
According to the Appellate court, the tribunal was wrong to have reached conclusion on over-voting based on evidence on the back-end server report, not from the BVAS accredited data.
The Appeal court also held that the tribunal erred when it held an issue of certificate forgery against Adekele, the same having been decided by the Court of Appeal before.
