Three Political parties, the People’s Party of Nigeria (PPN), Alliance for Democracy (AD) and Alliance Congress Party of Nigeria (ACPN) have sued Adamawa Government for appointing Local Governments Head of Service as Acting Council chairmen.
The case which was mentioned Monday at a Yola High Court presided over by Justice Nathan Musa has been adjourned to 14th of this month for hearing.
The parties dragged to court the Attorney General of Adamawa, Adamawa State Independent Electoral Commission, Ministry for Local Government and the Head of Service for the 21 local government areas of the state as defendants.
The parties were seeking for a declaration that by virtue of the provision of section 7 of the 1999 Constitution and section 13 of the local government law, CAP 80, laws of Adamawa state of Nigeria, 1997, the manning of local government councils by head of service is undemocratic and unconstitutional.
The parties also want the court to order the state independent electoral commission to conduct elections into elective offices in the 21 local government area councils within 90 days.
They also want a court order directing the state attorney general and ministry for local government to hold in trust all funds accruable to all the 21 local government councils from the federation and state accounts and internally generated revenues from local government areas pending the inauguration of elected council members.
